REQUIREMENTS FOR ACQUIRING VARIOUS TITLE DOCUMENTS IN LAGOS STATE


Requirement for Grant of Statutory Right of Occupancy on State Land

  • 3 survey Plans
  • Application form duly completed
  • Vital information form duly completed
  • 4 copies of 5x5cm coloured passport photograph on white background
  • Original payment receipts
  • Evidence of payment of tax liabilities

Requirement for Governor’s Consent to subsequent land transaction

  • Dated letter of application with address and telephone no(s)
  • Completed Form 1c
  • Certified True Copy of Grantor’s Title
  • Grantor’s Tax Clearance Certificate
  • Grantees Tax Clearance Certificate
  • 4 Nos. duly executed deeds of Sublease, Assignment, Mortgage or Power of Attorney
  • Chartable Survey Plans
  • Evidence of payment for charting, endorsement and form 1c (N10,500)
  • Evidence of payment of property tax such as Land Use Charge, Capital Gains Tax, etc
  • Original letter of capital contribution payment confirmation from NTDA in respect of Lekki Schemes 1 & 2
  • Building plan where applicable and photographs of the property

Requirement for Deemed grants on privately acquired Lands are as follows:-

  • Application Form duly completed and sworn to
  • Land Information Certificate
  • Receipt for Land Information fee
  • Copy of tax clearance Certificate (individual)
  • Copy of Certificate of incorporation/registration (for companies)
  • Copy of company income tax clearance certificate
  • Copy of tax clearance certificate of 2 directors of the company
  • Site location Sketch
  • Copy of approved building plan (if developed)
  • Photographs of the Site
  • A copy of publication relating to the processing of the Deemed Grant
  • Evidence of payments
    • publication fee- N20,000.00
    • 8% of application rate in the location (subject to the minimum of N50,000.00)
    • Application Form- N5,000.00

Covering letter stating all submitted documents addressed to the Executive Secretary, Land use & Allocation Committee must be attached to the completed application form upon submission.


Requirements for Regularisation of title on Federal Government Grant in Lagos State

  • Formal letter addressed to the Executive Secretary, Land Use and  Allocation Committee Block 13 Room 4, Lands Bureau, the Secretariat, Alausa, Ikeja
  • Standard allocation form (FREE)
  • Purchase Receipt
  • Passport Photographs
  • Tax Clearance Certificate of the applicant
  • Development Levy
  • In case of Company, two Directors Tax Clearance Certificates and Development Levy receipts
  • Survey Plan
  • All payment receipts of land Charges
  • Certified True Copy of the root of title

Procedure for regularisation of the title to land previously acquired by the state government

Stage 1 Applicant submits application for regularization to the Directorate of Land Regularization for processing.

Stage 2 The Directorate of Land Regularization will chart the survey plan and thereafter carryout site inspection of the land

Stage 3 If the report of inspection is approved, the Directorate of Land Regularization further process by raising a demand notice for necessary payment.

Stage 4 Upon payment of necessary Land Charges evidenced by treasury receipt, the Directorate of Land Regularisation prepares the letter of allocation for processing the Certificate of Occupancy and forward same to the Executive Secretary, Land Use and Allocation Directorate for endorsement and thereafter release to the applicant.

Stage 5 The applicant’s file containing the Certificate of Occupancy is sent through the Permanent Secretary to the Hon. Attorney General and Commissioner for Justice for Endorsement.

Stage 6 The Certificate of Occupancy is further processed for stamp duty and registration and released to the applicant.


Requirement for Ratification and Certificate of Occupancy

  • A covering letter by the Agent or individual person submitting the application must accompany the Application Form with the following: A covering letter which must contain the contact details – Address, Telephone Nos. and where possible an e-mail address.
  • A duly completed Land Regularisation Form 1 obtained from the Lands Bureau. Application form for Residential users cost N5,000.00 while Forms for Commercial is N10,000.00.  The form must be completed, dated and signed by the Applicant and sworn to before a magistrate or notary public.
  • 4 Passport Photograph (with coloured white background 5x5cm in size) 
  • Land Information Certificate from Surveyor General (original)
  • Photocopy of Purchase Receipt with Stamp Duty
  • N100 current Special Development Levy
  • Current Tax Clearance Certificate or Electronic Tax Clearance Certificate
  • Sketch map of site Location
  • Original Survey Plan (4 copies)
  • Photocopy of Property
  • One Original copy of Deed of Assignment

SURVEYOR-GENERAL’S OFFICE

Land Information Certificate is issued by the surveyor General’s Office and at times may be revalidated (where applicable).

Requirement for Land Information Certificate

  • Covering letter addressed to Surveyor General
  • Sun print survey plan
  • Receipt of payment

PHYSICAL PLANNING

Approval of building plan and conformity of the land use to the zoning regulations.

Requirements for the Processing of Building Plan for Approval at Lagos State Physical Planning Permit Authority (LASPPPA)

The following documents must be submitted at the point of registration of all applications for building plan approval in line with the state policy on Operation 30 30; an acronym for speedy processing/approval of building plan applications:

Five (5) Sets of each of:-

  •  Architectural Drawings,
  • Structural Drawings  with detailing/calcuilations and letter of  structural stability from COREN certified Engineer.
  • Sanitary and Plumbing Drawings
  • Electrical Drawings
  • Mechanical Drawings

where applicable

  1. One (1) Sun print copy of Survey Plan.
  2. Proof of Land Ownership such as Certified True copy of Title Document (C of O), Letter of Ratification in case of Government Acquisition or Revocation Areas, Governor consents, etc.
  3. Receipts of  all Land Charges paid to date in case of State Land
  4. Receipts of Lagos State Special Development Levy in respect of the TCC.
  5. Receipts of Land Use Charge paid to the Government in respect of properties owned by the applicant/Sworn Affidavit in lieu.
  6. Receipt of processing fees payable in cash or bank drafts to Lagos State Government at desingnated banks.
  7. Environmental Impact Assessment (EIA) in respect of all Commercial Industrial,  Institutional applications and some other uses prepared by Urban and Regional Planner registered by NITP/TOPREC.
  8. Letter of Clearance from the following Government agencies:-
  • Change of Use & Approval in Principle from Ministry of Physical Planning & Urban Development
  • Planning Information from Special Applications Unit in respect of Special Applications: Places of Worship, Filling Stateions, Shopping Complex, Schools, Banks, Eateries, Mortuaries & Hotels
  • Land Use & Allocation Directorate: all State lands and Government Schemes
  • Land Services Department: For Governor’s Consent and subsequent transactions on landed propoerties.
  • Ministry of Transportation metro line project, in case of properties around the proposed metro line alignment/ corridor.
  • Drainage Department of MEPP: –  Applications within, drainage alignment, gorge, flood plain, river/water bodies, Lagoon, shoreline etc
  • Urban Renewal Board: applications that fall within Urban Renewal Scheme Areas.
  • Lagos State Surveyor General’s Office for applications that fall within acquisition, revocation and excision boundaries.

LAGOS STATE URBAN RENEWAL AUTHORITY

All applications within blighted area or LASURA Scheme are referred for clearance so that the service plots could be preserved.  One of the cardinal objectives of the Authority is the identification of slum areas and preparation of scheme on same.

Requirements for clearance letter from LASURA

  • Application for clearance address to the General Manager
  • Body of the letter must include: Location/Address
  • Name of applicant which must correspond with the name on the survey plan
  • Survey plan
  • Assessment papers and lastly
  • Payment Receipts
